Terms and Conditions of Use
Chuckie Bags Terms and Conditions Of Trade
All orders for goods made by you and accepted by Chuckie
Bags ("we/us") through chuckiebags.com, chuckiebags.co.uk, chuckie-bags.com,
chuckie-bags.co.uk chuckybags.com, chuckybags.co.uk, chuckiebag.com or
chuckiebag.co.uk (the "Web site") are subject exclusively and strictly to these
Terms and Conditions of Trade:
Ordering
All orders made by you through the Web site are subject to
acceptance by us. We may choose not to accept your order for any reason.
No contract will exist between you and Chuckie Bags for the sale by us to you
of any product unless and until we accept your order by email confirming we
have dispatched your product. That acceptance will be deemed complete and for
all purposes to have been effectively communicated to you at the time we send
you the email (whether or not you receive that email).
If the goods you have ordered are not available from stock we will contact you
by email and offer you the option to:

wait until the goods are available from stock; or
-
cancel your order
If we don't hear back from you we will wait until the goods are available from
stock and fulfil your order.
Description Of Goods & Prices
After we receive your order, we will confirm by email the details, description
and price for the items you have chosen. If these differ from the details,
description and/or price shown on the Web site and you wish to cancel your
order please see Cancelling an Order below. All details, descriptions and
prices for the goods appearing on the Web site are correct at the time when the
information was inputted. You should check any received goods on arrival to
ensure that they are not faulty. We reserve the right to change the price and
specification of any item on the Web site without notice.
Right To Withdraw Items
We reserve the right to withdraw any items from the Web site at any time
and without notice. We will not be liable to you or anyone else for withdrawing
any items from the Web site or refusing to process an order.
Payment & VAT
The total cost of your order is the price of the goods plus delivery charges as set
out in the Deliveries section, and will be confirmed to you by the Web site and
by email when the order is confirmed. Payment can be
made by most major credit or debit cards and is taken by WorldPay. More
information on WorldPay is available here. You
confirm that the credit/debit card that is being used is yours. All
credit/debit card holders are subject to validation checks and authorisation by
the card issuer. If the issuer of your card refuses to authorise payment, we
will not be liable for any delay or non-delivery and we are not obliged to
inform you of the refusal. We are not responsible for your card issuer or bank
charging you as a result of our processing of your credit/debit card payment.
The price for the goods as set on the Web site includes VAT for EU deliveries.
We are not responsible for any other importation taxes, sales taxes or charges
that may be levied at the delivery destination. Our VAT number is GB 592 0114 64.
Delivery & Risk
We despatch items ordered by you, as they are available using
First Class Royal Mail in the UK and Airmail outside of the UK, dependant on
the weight of the order. We will despatch your order as soon as possible, but this may not be on the day you place your order.
If you order is urgent please let us know and we will endeavour to despatch it so your order reaches you in time.
The delivery charges are set out in the Delivery
Charges section. Orders will only be sent to the address that you provide as the
cardholder's address, which will be verified by WorldPay. We will use our
reasonable endeavours to ensure that the estimated delivery times set out in
the Deliveries section are met but we cannot accept any liability for late
deliveries. On occasion items may be lost in the post. If you suspect this has
occurred first contact your local post office to check that the delivery isn't
being held for you and then contact us. Once you have received the goods, all
risk of damage to, or loss of, the goods shall pass to you. If you intend to
cancel your order you must keep good care of the goods pending their return to
us.
Limitation Of Liability
To the fullest extent permissible under law, we
disclaim any and all warranties of any kind (whether express or implied) in
relation to goods purchased by you through the Web site. Your statutory rights
as a consumer are not affected. Our liability in contract, tort, negligence,
pre-contract or other representations or otherwise arising out of or in
connection with these Terms & Conditions of Trade shall be limited in aggregate
to all sums paid by you to us. In any event, we shall not be liable to you
under, or in connection with these Terms & Conditions of Trade in contract,
tort, negligence, pre-contract or other representations (other than fraudulent
or negligent representations) or otherwise for any economic loss (including
without limitation loss of revenues, profits, contracts, business or
anticipated savings) or for any special or indirect losses whatsoever. Nothing
in these Terms & Conditions of Trade shall exclude or limit liability for death
or personal injury resulting from our negligence or that of our agents or
employees.
Cancelling an Order
If you want to cancel an order before it has
been despatched then contact us by phone or email and we will cancel the order.
Payment is not taken until the order is despatched.
Returns Policy
If for any
reason you are unhappy with your purchase, you can return it to us in its
original condition within 30 days of the date you received the item and we will issue a full
refund for the price you paid
for the item, including postage. If the item is faulty we will also refund postage costs incurred by
you. If possible enclose a receipt from the post office. If you require a
refund, the entire amount including initial delivery, will be refunded. If you
are returning the item for any other reason we do not refund your return
postage. This returns policy does not affect
your statutory rights as a consumer.
How to Return an Item
Please follow the
steps below to enable us to process your refund efficiently:- fill out the
back of the receipt and, if possible, giving the reason for the return so we can improve our products.
- if you don't have your
receipt please write your name, address, telephone number and email address on
a piece of paper with the reason for return. If you have your order number then
please include this.
- in the case of a faulty product, please provide a full
description of the fault in the space provided on the back of your receipt.
Please indicate whether you require a replacement item or refund. If you don't
have your receipt please write your name, address, telephone number and email
address on a piece of paper with a description of the fault and whether you
want a replacement item or refund. If you have your order number then please
include this.

Conditions of Trade shall be governed by the laws of England and you agree to
submit to the exclusive jurisdiction of the High Court of England & Wales.
